General terms and conditions of contract

Additional costs

The additional costs (such as electricity, not for e-charging stations, water, heating) are included in the rental price. Incidental costs/additional services not included in the rental price will be invoiced separately and must also be paid before departure. Visitor/guest taxes are not included in the rental price.
Handover of the rented property; complaints
The rented chalet shall be handed over to the hirer in a clean and contractually compliant condition. Should there be any defects or the inventory be incomplete at the time of handover, the hirer must report this immediately to reception. Otherwise, the rental property shall be deemed to have been handed over in perfect condition. Should the tenant take over the chalet late or not at all, the entire rental price remains owed.



Careful use

The hirer undertakes to use the rented accommodation with care, to comply with the house rules laid down and to show consideration for other guests and neighbours. In the event of damage, the reception/owner must be informed immediately. A maximum of 4 persons per chalet are allowed, plus small children up to the age of two in a cot. Subletting is not permitted. The tenant is responsible for ensuring that all the other occupants of the chalet comply with the obligations in these General Terms and Conditions. If the tenant conspicuously violates the obligations of careful use or if the chalet is occupied by more than the contractually agreed number of persons, Tomtegl GmbH may terminate the contract without notice and without compensation.



Return of the rented property

The rented property must be returned on the day of departure by 11:00 a.m. at the latest in a tidy condition, including inventory and swept clean. Food, rubbish and empty bottles must be disposed of properly. If the object is not returned in a clean and tidy condition, a one-off additional cleaning fee of € 100.00 will be charged due to the additional cleaning effort. The tenant is liable to pay compensation for any damage and/or missing inventory, or this will be offset against the deposit if this is sufficient.



Cancellation

Cancellation up to 45 days 30% cancellation fee on the total travel price, 30 to 44 days 50% on the total travel price, 14 to 29 days 70% on the total travel price, 13 days to 1 day before arrival 90% on the travel price. In the event of early departure, rental termination or cancellation on the day of arrival, the entire rental price remains owed. For each rebooking and cancellation, we charge an additional one-time processing fee of € 150.00.



Travel cancellation insurance

We recommend that you take out travel insurance with your booking. Events such as illness, accident or other undesirable occurrences, even within the family, can happen unexpectedly. With the cancellation insurance of our partner Europäische Reiseversicherung you can protect yourself against these risks. You can find it on our website www.tomtegl-bergchalets.com.



Force majeure

If the rental becomes impossible or disproportionately difficult due to force majeure (e.g. snow, water, storm and fire damage) or other events (e.g. events, construction noise, repair work, etc.), the landlord is entitled to terminate the contract without notice. Claims for damages by the lessee are excluded. Tomtegl GmbH is entitled (but not obliged) to offer the hirer a substitute object of equal value to the exclusion of claims for compensation.



Liability

Tomtegl GmbH is liable for the accuracy of the description of the rented property and is obliged to provide the contractually agreed services properly and to maintain them throughout the rental period. Tomtegl GmbH is not liable according to § 536a BGB. Tomtegl GmbH's liability in tort is excluded unless it is based on an intentional or grossly negligent breach of duty by Tomtegl GmbH. Tomtegl GmbH is not liable in cases of force majeure (see above). The hirer is liable for all damage caused by him or fellow users or passengers, fault is presumed.



Keeping pets

Pets are welcome. However, animals, especially dogs, may only be kept or temporarily kept with the express permission of the landlord. The permission is only valid for the individual case and can be revoked at any time if unpleasantness occurs. It is strictly forbidden to keep animals in beds, on seating furniture and in sanitary areas such as bathrooms/WC, sauna, pool area, fitness room, massage area and village shop. In case of non-compliance, the landlord may terminate the rental contract with immediate effect and charge additional cleaning costs afterwards. The tenant is liable for all damages and additional cleaning costs caused by keeping animals.



Smoking, barbecue and fireworks ban

All mountain chalets are non-smoking properties. Smoking and barbecuing in the garden or on the terraces as well as with open windows or in front of the chalet entrance door is strictly prohibited due to the risk of fire. It is also strictly forbidden to set off fireworks. Failure to comply will result in an official fine and immediate termination of the rental contract. The tenant is fully liable for any damage.



Fireplace, liability

There is a wood-burning stove in all mountain chalets. This may only be lit with the firewood provided or purchased. It is forbidden to use paper, cardboard or other materials to light the fire. Please use the lighters provided. Make sure that no hot ash from the fireplace falls onto the floor. Ashes must not be disposed of in the kitchen or bathroom rubbish bin. In addition, ensure that there is a sufficient supply of fresh air. Fireplaces can become very hot and should therefore be avoided by children. Parents are liable for their children. Parents are also liable for their children in the entire outdoor pool area, in the fitness room and on the entire mountain property of Tomtegl Bergchalets GmbH.



Quiet times

Out of consideration for other guests and neighbours, please accept our quiet hours. These are between 22:00 and 7:00.



Applicable law and place of jurisdiction

Austrian law is applicable. Klagenfurt am Wörthersee is agreed as the place of jurisdiction.
